GENERAL TERMS AND CONDITIONS

The PARTY CURATORS is engaged in the business of event styling and coordination and the CLIENT desires to avail of the same under the following terms and conditions:

• • PURPOSE: The PARTY CURATORS will render the services in favor of the CLIENT.
    
    For the purpose of this agreement, “services” mean any and all work as chosen in this form. Completing this booking form means you red, understood, examined and acknowledged all the inclusions of each item you are choosing based on the description given here in our website.

• • COMPENSATION: In consideration for the services, the CLIENT shall pay the PARTY CURATORS the QUOTED price agreed and stated here in the booking form.
    
    The following shall be strictly complied with by the CLIENT and his or her failure is a ground for the PARTY CURATORS to terminate the agreement as provided by clause no. 12 :
    
    50% is the asking deposit/payment upon the execution of this form and the full payment should be made at least 1 week before the party (may vary in the booking period).
    
    If you have additional requests that is not available in this form, you can put it in the remarks below and it will have the same terms of payment as stated above.
    
    This is without prejudice to the damages and penalties which the CLIENT may incur and be held liable as specified below.
    
    
    • VENUE, SERVICES, ACCESSORIES, AND EQUIPMENT:
      • • The set-up time is for the minimum period of FOUR (4) hours prior to the start of the event. The purpose of the set-up time is to allow the PARTY CURATORS to properly decorate the venue and execute the agreed concept for the event;The set-up time pertains to all the time necessary to furnish, fix, and design the venue in accordance with the desired theme or concept. It is reckoned from the time all the props and furniture were unloaded from the vehicles.A set-up time of less than FOUR (4) may result in a substandard quality of work, in which case the PARTY CURATORS shall be free from any liability by reason thereof;
      • • All the props and furniture are only for rent;The CLIENT shall be solely responsible for the costs of damaged or lost props and furniture whether the same be damaged or lost by the CLIENT, his or her family members, or any guests due to any reason. The costing of the damaged or lost props and furniture shall be based on its current market price;
      • • The CLIENT shall provide a cash meal allowance in the amount of PhP150 to each styling crew member. The styling crew has a minimum member of Four (4) persons.Other staff from a third-party supplier such as lights and sounds, photo booth, host and magician, among others, are separate from PARTY CURATORS’ styling crew and have a separate meal allowance as provided in the attached Statement of Work;
      • • The CLIENT shall provide at least one (1) parking slots for the vehicle of the PARTY CURATORS necessary to perform the services unless a different number of parking slots were requested by PARTY CURATORS depending on its needs and the circumstances.
      • • For venue located at the 3rd to the 10th floor of a building, a flat rate hauling fee in the amount of PhP150.00 per styling crew member shall be charged against the CLIENT and additional PhP25.00 for every succeeding floors.
      • • For venues located outside Metro Manila, transportation costs shall be charged against the CLIENT in the amount provided in the attached Statement of Work.
      • • The maximum period of the services per event is only for four (4) hours for a kiddie party, baptism and all other events;Any extension in excess of the above mentioned period shall be charged in the amount of PhP1,500.00 per hour. A fraction of an hour is considered and shall be charged as one (1) full hour.The foregoing additional charges pertain only to PARTY CURATORS’ styling crew and any charges from the third-party supplier included in the PARTY CURATORS’ services has a separate charge as provided in the attached Statement of Work;
      • • In case the services include furniture, props, or any items which require electricity to operate, the CLIENT shall ensure that there are enough electric sources to provide power to such furniture, props, or items as necessary;
      • • The CLIENT allows the PARTY CURATORS to display and distribute the latter’s business cards and fliers at the venue during the event.
      
      
      • GOVERNMENT PERMITS: The CLIENT shall be solely responsible for securing all the necessary governmental and regulatory permits, gate passes, authorizations, and clearances necessary for the PARTY CURATORS to perform its obligation under the agreement.All costs and expenses incurred in connection with the same shall be fully shouldered by the CLIENT.
        The PARTY CURATORS shall not be responsible for any delay or failure in the set-up of the venue due to the failure of the CLIENT to secure any of the said documents prior to the date of the event;
      
      
      • SUBCONTRACTING: The PARTY CURATORS may, at its option, subcontract the services under a Statement of Work but the use of subcontractors by PARTY CURATORS shall not alter, revise, or affect its obligations under the Statement of Work.
      
      
      • SERVICES WARRANTY AND LIMITED LIABILITY: All Services to be executed hereunder will be performed in a diligent, professional manner and in good faith and according to PARTY CURATORS’ business practices.In case of the failure of the third-party supplier, such as the lights and sounds, photo booth, host and magician, among others, to render their services during the event, the CLIENT shall have the right to refund only and limited to the amount paid for that specific service.
      
      
      • NON-LIABILITY OF PARTY CURATORS FOR FORTUITOUS EVENT, ACTS OF GOD AND FORCE MAJEURE: The PARTY CURATORS shall not be liable for any damage or loss by any reason caused by a third party, government regulations, or by fortuitous events/ force majeure, such as but not limited to fire, flood, typhoon, earthquake, civil disorder, labor strikes, rebellion, widespread disease or any other circumstances beyond the control of the PARTY CURATORS which effectively prevented the performance of its obligations under the agreement;For the purpose of this agreement, a “third party” means any person or entity other than the PARTY CURATORS, its officers, representatives, members, employees, or agents.In case of unforeseen ENHANCED or Strict Community Quarantine imposed by the government the said deposit can be converted to a STYLING FUND on which the client may opt to use for their future events. A different order, theme and inclusions from the previous contract shall be charge at cost.
      
      
      • POSTPONEMENT AND RESCHEDULING: In case the CLIENT seeks to postpone and reschedule the event, the CLIENT shall notify the PARTY CURATORS in writing of such intention at least two (2) weeks before the date of the event, otherwise the CLIENT is deemed barred. The proposed rescheduling date must be within six (6) months from the postponed original date, subject to the PARTY CURATORS’ availability and without prejudice to the PARTY CURATORS’ right to renegotiate the terms and stipulations of this agreement due to applicable price adjustments particularly for consumable items such as but not limited to, desserts, pastries, candies, sweets, cakes, among others.
      
      
      • EFFECT OF PAYMENT/ DEPOSIT: The payment or any deposit made by the CLIENT in favor of the PARTY CURATORS as consideration for the agreement signifies that the CLIENT completely understood the stipulations herein and voluntarily assumes all his or her obligations imposed under this agreement.
      
      
      • DELAY: The CLIENT shall hold PARTY CURATORS free from any liability arising from delays due to the acts and instructions of the CLIENT, its representatives, relatives, guests, agents, or other third parties.
      
      
      • CANCELLATION AND REFUND: All deposits and payments made by the CLIENT are non-refundable and non-transferrable for any reason, including, but not limited to fortuitous event or force majeure. The cancellation of the agreement by the CLIENT for any reason whatsoever will revoke the whole amount already paid and received by PARTY CURATORS and shall be forfeited in favor of PARTY CURATORS;
      
      
      • TERMINATION OF THE AGREEMENT: The PARTY CURATORS reserves the right to terminate the agreement and forfeit the amount already paid if the CLIENT refuses or fails, willfully or negligently, to perform his/her obligations set forth herein.
      
      
      • CONFIDENTIALITY CLAUSE: Neither party has the right to disclose any confidential information of the other, in whole or in part, to any third party, and neither party will make use of such confidential information of the other for its own or a third party’s benefit or in any way use such Confidential Information other than for the purposes of performance of this Agreement without the prior written consent of the disclosing party. For the purpose of this agreement, “confidential information” pertains to any and all information disclosed by the parties which are necessary for the execution of the agreement.
      
      
      • SOCIAL MEDIA PUBLICATIONS: The PARTY CURATORS shall have the right to use the photos and videos of the event for promotion, advertising, and for any other lawful purpose in line with the PARTY CURATORS’ business. The CLIENT agrees and must inform any person attending and present during the event that any photos or videos taken which involves them may be used by PARTY CURATORS for any lawful purposes. The CLIENT and all the persons attending the event discharges PARTY CURATORS from any liability arising from the use of such photos or videos.
      
      
      • ON DEFAMATION: Any libelous posts on Facebook or any social media outlet by the CLIENT, his or her family members, friends, guests, acquaintance, representative, and agents against the PARTY CURATORS are prohibited by law and shall be dealt with under the pain of criminal, civil, and administrative penalties provided law;
      
      
      • AMICABLE SETTLEMENT: Both parties agree to abide by the terms and conditions laid out in this agreement. In case of a dispute between the PARTY CURATORS and the CLIENT regarding the interpretation and performance of any of its provisions, both parties shall seek to resolve such dispute amicably before resorting to litigation.
      
      
      • JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial relief against the other, the losing party shall pay an amount of One hundred percent (100%) of the amount claimed in the complaint as attorney’s fee which shall in no case be less than PhP50,000.00 in addition to other costs and damages which the winning party may be entitled to under the law. IN CASE OF DEFICIENCY: The deficiency of this agreement shall be supplemented by the provisions of existing laws.
      
      
      • This agreement was thoroughly read, examined, and signed by the parties with the full understanding of its contents and stipulations and the legal implications thereof.
